These Terms, Conditions & Privacy Policy (“Agreement”) govern your use of services provided by Cheeseology Tampa LLC (“Cheeseology,” “we,” “our,” or “us”), a Florida limited liability company.

By booking, attending, or using our services, you (“Participant,” “you,” or “Guest”) agree to be legally bound by this Agreement.

1. ACCEPTANCE OF TERMS

By purchasing, booking, attending, or participating in any Cheeseology class, event, or service, you:

  • Acknowledge that you have read and understand this Agreement
  • Agree to be legally bound by its terms
  • Represent that you are at least 18 years of age or are the legal guardian of a minor participant

2. ARRIVAL & PARTICIPATION POLICY

  • Guests must arrive no less than 15 minutes prior to the scheduled start time
  • Classes begin promptly and will not be delayed
  • Late arrivals may be refused entry without refund if participation would disrupt the class

3. BOOKING, CANCELLATION & REFUND POLICY

  • ALL SALES ARE FINAL. NO REFUNDS WILL BE ISSUED.
  • Cancellations made at least 24 hours in advance will receive a store credit only
  • Store credits:
  • Expire one (1) year from issue date
  • Are non-transferable and have no cash value
  • Failure to provide proper notice constitutes a no-call/no-show, and all payments are forfeited

Cheeseology reserves the right to cancel or reschedule any class due to:

  • Insufficient enrollment
  • Instructor availability
  • Safety concerns or unforeseen circumstances

In such cases, Cheeseology will provide either:

  • A full refund, or
  • Store credit, at its sole discretion

4. ASSUMPTION OF RISK & RELEASE OF LIABILITY

THIS SECTION CONTAINS A RELEASE OF LIABILITY. PLEASE READ CAREFULLY.

Participation in Cheeseology activities involves inherent risks, including but not limited to:

  • Burns, cuts, lacerations, slips, and falls
  • Use of hot surfaces, sharp utensils, and kitchen equipment
  • Food-related illness, allergic reactions, or choking
  • Other injuries, including serious injury or death

By participating, you expressly agree to:

  1. ASSUME ALL RISKS, known and unknown, inherent or otherwise
  2. RELEASE, WAIVE, AND DISCHARGE Cheeseology Tampa LLC, its owners, members, managers, employees, contractors, agents, affiliates, and landlords (“Released Parties”) from any and all liability
  3. COVENANT NOT TO SUE the Released Parties for any claims arising out of participation
  4. Accept that this waiver applies to the fullest extent permitted under Florida law, including claims of negligence

5. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Cheeseology and its Released Parties from any claims, damages, liabilities, costs, or expenses (including attorney’s fees) arising out of:

  • Your participation
  • Your violation of this Agreement
  • Any damage caused by you or your guests

6. FOOD ALLERGY & HEALTH DISCLAIMER

  • Cheeseology uses ingredients that may contain dairy, nuts, wheat, soy, and other allergens
  • We cannot guarantee an allergen-free environment
  • Cross-contamination is possible at all times
  • Participation is at your own risk

You acknowledge:

  • You are responsible for disclosing allergies
  • Cheeseology makes no warranties regarding ingredient safety

7. MEDICAL CONSENT

In the event of an emergency:

  • You authorize Cheeseology to seek medical assistance on your behalf
  • You accept full financial responsibility for any medical care

8. PHOTOGRAPHY & MEDIA RELEASE

You irrevocably grant Cheeseology the right to:

  • Photograph, record, and use your image, likeness, or voice
  • Use such media for marketing, advertising, and promotional purposes

You:

  • Waive all rights to inspect or approve use
  • Waive any right to compensation

9. MINORS

  • Participants under 18 must be accompanied by a parent or legal guardian
  • The guardian agrees to all terms on behalf of the minor
  • The guardian assumes full responsibility for the minor’s participation

10. USE OF DIGITAL SERVICES

You agree not to:

  • Use Cheeseology platforms for unlawful purposes
  • Attempt unauthorized system access
  • Interfere with website or booking systems

11. INTELLECTUAL PROPERTY

All Cheeseology materials, branding, and content are protected under U.S. law.

Unauthorized use, reproduction, or distribution is strictly prohibited.

12. THIRD-PARTY SERVICES

We may utilize third-party vendors (e.g., payment processors).

  • Cheeseology is not liable for third-party actions, errors, or breaches
  • Use of such services is at your own risk

13. PRIVACY POLICY

Information We Collect

  • Name, email, phone number
  • Billing/payment details
  • Booking and participation history
  • Preferences and interactions

How We Use Information

  • Process transactions
  • Provide services
  • Send communications and marketing (opt-out available)
  • Improve operations and customer experience

Information Sharing

We do not sell personal information. We may share data with:

  • Payment processors
  • Booking platforms
  • Service providers necessary for operations

We implement reasonable safeguards; however, no system is completely secure.

Your Rights

You may:

  • Request access to your data
  • Request corrections or deletion

14. LIMITATION OF LIABILITY

To the fullest extent permitted by Florida law:

  • Cheeseology shall not be liable for indirect, incidental, or consequential damages
  • Total liability shall not exceed the amount paid for the service

15. GOVERNING LAW & VENUE

This Agreement shall be governed by the laws of the State of Florida.

Exclusive venue for any disputes shall be: Hillsborough County, Florida

16. DISPUTE RESOLUTION

At Cheeseology’s discretion, disputes may be resolved through:

  • Binding arbitration in Florida
  • Waiver of class action rights

17. MODIFICATIONS

Cheeseology reserves the right to update these terms at any time. Continued use constitutes acceptance.

18. SEVERABILITY

If any provision is found unenforceable, all remaining provisions remain in full force.

19. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between you and Cheeseology.
